By accessing or using Kestrel ("Service"), you agree to these Terms. If you do not agree, do not use the Service.
Kestrel is an AI-powered lead qualification platform for real estate professionals. The Service sends automated SMS messages to leads on your behalf, scores leads using AI, and provides follow-up tools. You are responsible for all activity under your account.
You represent and warrant that:
Violations of TCPA or applicable telemarketing laws are solely your responsibility.
Paid plans are billed monthly via Stripe. You may cancel at any time; access continues through the end of the billing period. We reserve the right to suspend accounts for non-payment or Terms violations.
You may not use Kestrel to: (a) violate any law; (b) transmit unlawful, abusive, or deceptive content; (c) interfere with the Service or other users; (d) resell or redistribute the Service without written permission.
Kestrel uses AI (Claude by Anthropic) to generate SMS messages and lead scores. AI output is not guaranteed to be accurate. You are responsible for reviewing outbound communications. Kestrel makes no warranty regarding lead conversion outcomes.
Lead data you upload or collect belongs to you. See our Privacy Policy for how we handle personal data.
To the maximum extent permitted by law, Kestrel shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed fees paid in the three months preceding the claim.
You agree to indemnify and hold harmless Kestrel from any claims, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.
We may update these Terms at any time. Continued use constitutes acceptance. We may terminate accounts for material violations with reasonable notice.
